L'ARTICOLO 11 E 13 DELLA DIRETTIVA EUROPEA PER IL "DIGITAL SINGLE MARKET", NEL CONTESTO DELL'OPEN SCIENCE. UN PROBLEMA CITAZIONALE E DI DOCUMENT DELIVERY GLOBALE

Abstract The editorial concerns the consequences that the Proposal for a Directive of European Parliament and Council on copyright in the "digital single market" may have in the scientific world and the Open Science. The directive intends to modernize European standards on audiovisual copyright and collaborate with online platforms in order to create a fairer environment, unlocking the potential of an European data economy. The reform process is almost completed and the definitive text will be approved near January 2019, presumably without major changes from the current formulation. The most controversial points are Article 11, called Link Tax and Article 13 (upload filter). This will particularly concern online platforms such as Google News, YouTube, Pinterest, Facebook. These will be subjected to "adequate and proportionate" preventive measures, to avoid copyright regulations infringement. The impact on scientific communication, although not widely mentioned, is said to be little, since the scientific journals are not explicitly included in article 11, and in the art. 13. In reality, many of the provisions are, at best, of an unclear nature and scope, which will be the cause of legal uncertainty and delays in research. The communication supported by the Scientific / Social media for instance Research Gate and Mendeley Networks, without considering particular European infrastructures for publications and research data deposit such as Zenodo (OpenAIRE), institutional or disciplinary Open Archives and the scientific societies websites, could be interested by the restrictions of this Directive (citation modalities and use licenses). We know that the question of "access to ideas and data" has been thoroughly debated in Europe and Italy during these years. It is admitted that their free circulation is a cornerstone of the technologically advanced societies. Knowledge is the base of innovation and it is certainly dangerous restrict their availability, also in the name of a right and "fair compensation".
