LIBERTÀ CITAZIONALE E DIRETTIVA UE SUL COPYRIGHT NEL MERCATO UNICO DIGITALE - CITATIONAL FREEDOM AND EU DIRECTIVE ON COPYRIGHT IN THE DIGITAL SINGLE MARKET

Abstract The European Parliament and the Council proposal for a Directive on copyright in the digital single market (COM / 2016/0593) has come to an endpoint. Finally, just a few votes decided the endorsement of the "Copyright Directive in the European single market". The measure was accepted despite of controversial aspects, with a noticeable divergent approach characterizing players (publishers, researchers, content aggregators, politicians and members of civil society). A lack of connection, between the institutional subjects responsible for managing ordinary and above all scientific information, emerged in the generalist channels (radio, tv) and newspaper, the whole issue has been discussed very little. Due to the generic nature of the EU directives, an actual risk is that different countries of the Union, organize themselves in a poorly compatible way with the desirable free circulation of online information and data The problem mainly involves the atypical (social and informal) and non institutional scientific communication. The issue may involve the research activity of subjects of the entrepreneurial world such as: science and technology parks, spinoffs, small and medium technological enterprises and startup companies, private Universities and the like. In the debate, the generalist channels considered article 3 of the Directive (concerning the extraction of text and data), and article 11 (protection of journalistic publications in case of digital use) to be of minor importance. The new provisions concerning the two articles mentioned, would not be without consequences, particularly for teaching and research. However, the discussion mainly focused on the issues related to Article 13 (now 17; which governs the usage of protected contents by information society service providers, that store and give access to large quantities of file and data uploaded by users). In this regard there have been authoritative positions, in the sense of ensure a greater freedom of action, through a series of "open letters". University professors, researchers denounce the possibility that in the future it will be more difficult to get adjourned news from the Net and follow its evolution. For example, the work of freelance pressman linked to "citizen journalism", will certainly be more difficult and expensive. The discussion on Article 17 highlighted the difficulty to operate a distinction between the contents that can be freely published by those that are not (thus the negative consequences on information freedom), due to the strategies implemented in order to avoid the dissemination of prohibited publications through online platforms. In support of a closer regulation of the subject matter of Article 17, video and multimedia commercial operators intervened taking a sharp position, In favor of copyright protection. Also the italian associations of librarians, publishers and booksellers, have taken a similar position. This, without taking into consideration, as noted by many librarian and researchers, some provisions contained in articles 15 and 17, may interfere with the Open Science objectives in the European Union.
